ITANAGAR, 27 Sep: The Arunachal Tribal Against Injustice Forum (ATAIF) has reiterated its strong support for teachers with genuine and documented grounds for exemption from the recent transfer/rationalisation, and urged the Education Department to ensure that no genuinely affected teacher is compelled to move before their representation is duly examined and decided upon.

Expressing concern over the reported relieving of teachers before their representations are duly examined and decided upon, the forum stated that its concern is specifically with those who have submitted representations seeking exemption on grounds including non-completion of the mandatory three-year tenure, census duty, BLO duty, nearing retirement and other legitimate circumstances.

The forum, however, maintained that teachers who are genuinely eligible for transfer under the applicable rules may proceed as per due procedure.

Questioning the 'release first, redress later' approach in the recent transfer/rationalisation exercise, it stated that the proper sequence should be to "receive the representation, verify the facts, examine the grounds, take a reasoned decision, and then enforce the consequential action."

"If a teacher has submitted a genuine representation seeking exemption from transfer, what is the purpose or value of giving the decision on that representation only after the teacher has already been released from the district?" it questioned. The forum sought clarification on whether the direction for such release is coming from the education minister, the education secretary, the education commissioner or the directorate.

Stating that such a process cannot provide justice, the forum urged the Education Department to reconsider the relieving process and ensure that no genuinely affected teacher is compelled to move before their representation is duly examined and decided upon.

At the same time, the forum clarified that its demand is not for preferential treatment and not against legitimate administrative action; its the demand is simple, it said - hear the genuine representation first, decide on it fairly, and then take consequential action.
